Terms and Conditions
The Loaner Agreement constitutes the whole agreement between Broadway and the Customer regarding the loan of the Equipment and no condition, warranty or representation shall affect this transaction unless contained herein.
The Customer agrees to only use the Equipment for the Customer’s personal use in accordance with and in the manner contemplated by the Equipment’s operating instructions (which the Customer acknowledges receiving). The Customer will be responsible for the safekeeping and careful use of the Equipment while it is in the Customer’s possession and responsible to ensure that the Equipment is not damaged, stolen or lost while in the Customer’s care.
When the Equipment is returned, it shall be surrendered by the Customer to an authorized representative of Broadway. Equipment shall be deemed not to be properly returned unless and until an authorized representative of Broadway has confirmed in writing that the Equipment has been returned at the time and in the condition required by this Agreement.
Broadway shall not be obligated to accept the return of the Equipment if it is not returned at the time and in the condition required by this Agreement.
Broadway will not be responsible for any losses or damages incurred by the Customer, whether direct, indirect or consequential, arising from or related to the Customer’s use of the Equipment.
The Loaner Agreement shall ensure to the benefit of, and be binding upon, the heirs, personal representatives and/or successors of the parties.
